Welcome to Preloved Luxury NYC, Inc. (“Preloved Luxury NYC,” “we,” “our,” “us”). By accessing or using our website prelovedluxurynyc.com (the “Site”) and purchasing our products, you agree to the following Terms & Conditions. Please read them carefully before making any purchase.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Site and place an order. By using the Site, you confirm that you meet these requirements.

2. Products & Authenticity Guarantee

• We specialize in the resale of pre-owned luxury goods including handbags, small leather goods, shoes, jewelry, makeup, and accessories.
• All items are pre-owned and may show signs of wear. We provide detailed descriptions and photographs, but condition is subjective and may vary.
• Authenticity Guarantee: We stand by the authenticity of every item we sell. If you believe an item purchased from us is not authentic, you must provide a written certificate of inauthenticity from a reputable third-party authenticator. Upon verification, we will issue a 100% refund.

3. Orders, Pricing & Payments

• Prices are listed in U.S. dollars (USD) and are subject to change without notice.
• We reserve the right to cancel any order if a product is mispriced, out of stock, or otherwise unavailable.
• Payments must be made using the methods accepted on our Site.
• Additional Shipping Fees: If the actual cost of shipping exceeds the amount initially charged at checkout, we reserve the right to request additional payment to cover the difference before shipping your order.

4. Shipping & Delivery

• We offer worldwide shipping.
• Shipping times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs, or circumstances beyond our control.
• Risk of loss or damage transfers to the customer once the carrier marks the package as delivered to the shipping address provided.
• Insurance: We strongly recommend purchasing shipping insurance for your order. Once a package has been shipped and picked up by the courier, any damaged, lost, or stolen package will only be covered if the shipment was insured. If an order is not insured, lost, stolen, or damaged packages cannot be refunded or replaced.

5. Returns & Exchanges

• All Sales Final: All sales are considered final unless the item received does not match the description provided by Preloved Luxury NYC.
• Approval Required: Returns or exchanges will only be accepted in cases where the item was misrepresented or not as described, and must first receive approval from Preloved Luxury NYC.
• Timeframe: Requests must be submitted within 3 days of delivery, as indicated by the order’s tracking number. Once approved, the item must be shipped back within 48 hours of receiving approval.
• Condition: Returned items must be in the same condition as when sold. Items that show additional wear, damage, or alteration may be denied a refund or exchange.
• Refund Method: Approved returns will be refunded as store credit, unless otherwise stated in writing by Preloved Luxury NYC.
• Shipping Costs: Original shipping fees are non-refundable, and return shipping costs are the responsibility of the customer, unless otherwise specified.
• Exchanges: Approved exchanges are subject to product availability at the time of the request.

6. Condition Disclaimer

By purchasing from Preloved Luxury NYC, you acknowledge that items are pre-owned and may not be in brand-new condition. Normal wear, minor imperfections, or variations should be expected.

7. Limitation of Liability

To the fullest extent permitted by law, Preloved Luxury NYC shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Site or purchase of products. Our maximum liability is limited to the purchase price of the product in question.

8. Intellectual Property

All content on this Site—including logos, text, images, and design—is the property of Preloved Luxury NYC or its licensors. You may not reproduce, distribute, or use our content without prior written permission.

9. Governing Law

These Terms & Conditions are governed by the laws of the State of New York. Any disputes shall be resolved exclusively in the state or federal courts located in New York County, New York.
